Josiah Noyes probate page 1
Know all men by these presents that we Cutting Noyes and Thomas Noyes, Yeomen; Amos Lunt, Yeoman and Hannah his wife all of Brunswick in the County of Cumberland; Jacob Noyes and Josiah Noyes both of Portland in the same County, Merchants; and Moses Noyes of said Portland, Yeoman; William Lowell of the same Portland, Merchant and Betsey his wife and David Hale of Boston in the County of Suffolk, Gentleman do hereby constitute and make Moses Merrill of Falmouth in said County of Cumberland Esquire our attorney for us and in our names and behalf and to our use to ask demand take recover and receive possession from any person or persons whomsoever the same may concern any lands accounts or hereditaments or any interest thereon wherever situated which formerly belonged to and was the estate of Josiah Noyes, late of Falmouth aforesaid deceased and now belongs or is coming to us as his heirs or as representatives of his heirs or any of them or in any other way whatever and all monies due or to become due for former or future sales thereof or some part or parcel thereof and further to ask demand and receive of any persons as aforesaid any monies that may be due or coming forth on account of the passes or damages committed or done to the estate aforesaid or any part thereof as well as profits thereof and all other goods, effects, credits and things whatsoever due owing, belonging and coming unto us as heirs or representatives of heirs of the said Josiah deceased and we do hereby authorize our said attorney to bargain, sell and dispose of all our interest in the estate aforesaid with all the priveledges and appurtances or any part or parcel thereof to any person or persons and for such consideration as he may see fit and thereof to sign seal and acknowledge in our behalf good sufficient deed or deed of special or general warranty as he may judge proper avoiding if possible giving warranty deeds. Giving and hereby granting our said attorney our full and whole power to commence and prosecute a final judgement and execution any suits actions real personal necessary to accomplish the purposes aforesaid and to appear in the defense of any such suits or actions moved or to be moved against us respecting the matters aforesaid a final judgement and execution and to appear before Governors, Judges, Justices and other officers and ministers of justice as occasion may require and in case of sale as aforesaid for us
