Know ye that we Moses Noyes of Falmouth in the County of Cumberland and Province of Massachusetts Bay in New England, Yeoman, and Abigail my wife (late Abigail Thomes). For and in consideration of the sum of forty pounds lawfull money in hand before the ensealing hereof, well and truly paid by John Martin of Falmouth aforesaid, Mariner, the receipt whereof we do hereby acknowledge and ourselves fully satisfied and contented; and thereof, and of every part and parcel thereof, do exonerate, acquit and discharge him the said John Martin his heirs, executors and administrators, forever by these presents: have given, granted, bargained, sold, aliened, conveyed and confirmed; and by these presents, do freely, fully and absolutely give, grant, bargain, sell, aliene, convey and confirm, unto him the said John Martin his heirs and assigns forever a certain small lot of land lying and being in that part of the town of Falmouth aforesaid commonly called the Neck containing about ten rods more or less bounded as follows, beginning at a stake standing on the northeasterly side of Middle Street in the corner where the northwesterly side of Turkey Lane intersects said Middle Street and from said corner to extend northeasterly adjoining said Turkey Lane one rod and sixteen links or there abouts to a stake standing in the southwesterly line of land belonging to Joseph Thomes, Junr. and from the two aforesaid stakes to extend northwesterly adjoining said Middle Street on the one side and the said Joseph Thomes Junr.s land on the other side, five rods and eighteen links or thereabouts to Benjamin Cobb's land, together with the westerly half of the dwelling house thereon standing, being part of the land and house the said Abigail Thomes purchased of Joseph Thomes August 26, 1768 as by his deed may appear.
      To have and to hold the said granted and bargained premises, with all the appurtances, privileges and commodities to the same belonging or in any wise appertaining to him the said John Martin his heirs and assigns forever. To his and their only proper use, benefit and behoos forever. And we the said Moses Noyes and Abigail my wife for ourselves heirs, executors and administrators, do covenant, promise and grant to and with him the said John Martin his heirs and assigns, that before the ensealing hereof we are the true, sole and lawful owner of the above-bargained premises, and are lawfully seized and possessed of the same in our own proper right, as a good, perfect and absolute Estate of Inheritance in fee simple: and have in ourselves good right, full power and lawful authority, to grant, bargain, sell, convey and confirm said bargained premises in manner as aforesaid; and that he the said John Martin his heirs and assigns, shall and may from time to time, and at all times forever hereafter, by force and virtue of these presents, lawfully, peaceably and quietly have, hold, use, occupy, possess and enjoy the said demised and bargained premises, with the appurtenances free and clear, and freely and clearly acquitted, exonerated and discharged of, from all and all manner of former or other gifts, grants, bargains, sales, leases, mortgages, wills, entails, jointures, dowries, judgments, executions, or incumbrances of what name or nature so ever, that might in any measure or degree obstruct or make void this present deed.
      Furthermore we the said Moses Noyes & Abigail my wife for ourselves, our heirs, executors and administrators, do covenant and engage the above demised premises to him the said John Martin his heirs and assigns, against the lawful claims or demands of and person or persons whatsoever, forever hereafter to warrant, secure and defend by these presents in witness whereof we have hereunto set our hands and seals the second day of January Annoque Domini one thousand seven hundred and seventy one.)

Know ye, that we Moses Noyes of Gorham in the County of Cumberland, cordwainer, and Abigail his wife for and in consideration of the sum of thirteen pounds and ten shillings to us in hand before the ensealing hereof, well and truly paid by John Thresher of Falmouth in the county of Cumberland, farmer, the receipt whereof we do hereby acknowledge and ourselves therewith fully satisfied and contented; and thereof and of every part and parcel thereof, do exonerate, acquit and discharge him the said John, his heirs, ececutors and administrators, forever by these presents: have given, granted, bargained, sold, aliened, conveyed and confirmed; and by these presents do freely, fully and absolutely give, grant, bargain, sell, aliene, convey and confirm unto him the said John his heirs and assigns forever, twenty four square rods of land in that part of said Falmouth called the Neck, bounded beginning at a stake standing on the northeasterly side of Middle Street, so called, in the southerly corner of James Flood's lot, then running southeasterly adjoining said street three rods to a stake, and from those two stakes to extend northeasterly adjoining the said James Flood's said lot, and on the same course as far as that extends eight rods; keeping the width of three rods; being the same lot that Joseph Thomes conveyed to said Abigail as by his deed will appear.

      To have and to hold the said granted and bargained premises, with all the appurtenances, privileges and commodities to the same belonging, or in any wise appertaining to him the said John his heirs and assigns forever. To his and his heirs only proper use, benefit and behoof forever, and we the said Moses and Abigail forever our heirs executors and administrators, do covenant, promise and grant to and with the said John Thresher his heirs and assigns, that before the ensealing hereof, we are the true, sole and lawful owner of the above-bargained premises and are lawfully seized and possessed of the same in our own proper right, as a good right, full power and lawful authority, to grant, bargain, sell, convey and confirm said bargained premesis in manner as aforesaid: and that the said John his heirs and assigns shall and may from time to time, and at all times forever hereafter, by force and virtue of these presents, lawfully peaceably and quietly have, hold, use, occupy, possess and enjoy the said demised and bargainedpremises, with the appurtenances free and clear, and freely and clearly acquitted, exonerated and discharged of, from all and all manner of former or other gifts, grants, bargains, sales, leases, mortgages, wills, entails, jointures, dowries, judgments, executions, or incumbrances of what name or nature soever, that might in any measure or degree obstruct or make void this present deed.

Twenty acres more or less, it being two fifths parts for quantity equality of fifty acres or one ___ of Lot No. 43 in the 100 acre division on the west side Royals River in said North Yarmouth. Late the estate of Edward Butler deceased, together with the house and barn thereon. The said Moses paying three fifths of what said house and barn was appraised at before they were moved to those heirs who have not been bought out of said estate. To have and to hold the same to the said Moses Noyes his heirs and assigns to his and their use and behoof forever.

      And I do covenant with the said Moses Noyes his heirs and assigns that I am lawfully seized in fee of the premisis that they are free of all umbrances that I have good right to sell and convey the same to the said Moses to hold as aforesaid and that I will warrant and defend the same to the said Moses Noyes his heirs and assigns forever against the lawful claims and demands of all persons.

And I do covenant with the said Moses Noyes his heirs and assigns, that I am lawfully seized in fee of the afore granted premises; that they are free of all incumbrances; that I have good right to sell and convey the same to the said Noyes and that I will warrant and defend the same premises to the said Moses Noyes his heirs and assigns forever, against the lawful claims and demands of all persons.

      In witness whereof I the said True Worthy Tuttle have hereunto set my hand and seal this twenty sixth day of May in the year of our Lord one thousand seven hundred and ninety six. Memorandum the word (whereof) between the 16th and 16th lines was done before signing and sealing.

      To have and to hold the aforegranted and bargained premises, with all the privileges and appurtenances thereof, to the said David Spear his heirs and assigns to his & their use and behoof forever. And I do covenant with the said David Spear his heirs and assigns, that I am lawfullyseized in fee of the premises; that they are free of all incumbrances; that I have good right to sell and convey the same to the said David Spear his heirs & assigns to hold as aforesaid. And that I will warrant and defend to the said David Spear his heirs and assigns forever, against the lawful claims and demands of all persons.

      In witness whereof I the said Moses Noyes have hereunto set my hand this fourth day of February in the year of our Lord one thousand eight hundred and seventeen.

      To have and to hold the aforegranted and bargained premises, with all the privileges and appurtenances thereof, to the said Moses Noyes and Mercy Noyes their heirs and assigns to their use and behoof for ever. And I do covenant with the said Moses Noyes and Mercy Noyes their heirs and assigns, that I am lawfully seized in fee of the premises; that they are free of all incumbrances; that have good right to sell and convey the same to the said Moses Noyes and Mercy Noyes to hold as aforesaid and that I will warrant and assigns for ever against the lawful claims and demands of all persons. Provided nevertheless that if the said David Spear, his heirs, executors or administrators, perform to the said Moses Noyes or Mercy Noyes or to the one that shall survive the other all the covenants and conditions made in a certain bond of this date to him the said Moses Noyes and Mercy Noyes as aforesaid then this deed as also the certain bond bearing the date with these payments given by the said David Spear to the said Moses Noyes and Mercy Noyes aforesaid to perform at the time aforesaid shall both be void otherwise shall remain in full force.       To have and to hold the aforegranted and bargained premises, with all the privileges and appurtenances thereof, to the said Moses and Mercy their heirs and assigns to their use and behoof forever. And I do covenant with the said Moses and Mercy their heirs and assigns, that I am lawfullyseized in fee of the premises; that they are free of all incumbrances; that I have good right to sell and convey the same to the said Moses and Mercy their heirs & assigns to hold as aforesaid.     • (Know all men by these presents, that I Moses Noyes of North Yarmouth in the County of Cumberland and Commonwealth of Massachusetts, Yeoman, in consideration of the sum of forty dollars paid by George Titcomb, in the County aforesaid, Mariner, the receipt whereof I do hereby acknowledge...do hereby give, grant, bargain, sell and convey unto the said George Titcomb his heirs and assigns forever, all right, title and interest I have in and to all that farm or home place on which I now live in consequence of a deed of mortgage I have, given me by David Spear dated February 4th 1817 together with all the buildingss on said farm said farm is lying on the easterly side of the road called the Tuttle Road in said North Yarmouth and is the same that I sold and deeded to the said David Spear as by his deed from me may appear dated the fourth day of February 1817.

      To have and to hold the same, together with all the privileges and appurtenances thereof, to him the said George Titcomb his heirs and assigns forever. And I do covenant with the said George Titcomb his heirs and assigns, that I will warrant and forever the premesis to him the said George Titcomb his heirs and assigns forever, against the lawful claims and demands of all persons claiming by, through or under me.

      In witness whereof I the said Moses Noyes and Mercy Noyes wife of the said Moses in token of her relinquishing her right of dower have hereunto set our hands and seals this twenty eighth day of January in the year of our Lord one thousand eight hundred and eighteen.

    • The Noyes Descendants, Vol. I incorrectly identifies Moses on page 221 as a son of Josiah and Mary (Lunt) Noyes and shows all his children with Abigail Locke. This Moses is again correctly identified on page 206 with parents Nehemiah and Ann (Stickney) Noyes but no further information is provided beyond date of birth. He, his wife and children, have been confused or combined at times with the above Moses and his family; the trouble may have started with published records of the First Parish in Falmouth. There are grouped as one family five children baptized 1769-1787, two of them belonging to one Moses (wife Abigail [Cobb]) and three to another Moses (wife Abigail [Locke]).

      In the year 1794, one hundred and thirty of the inhabitants, residing in the west and north-west sections of ancient North Yarmouth, including what is usually called "Walnut Hill", and that part of the town incorporated in 1820 as the town of Cumberland, petitioned the Legislature to be incorporated as a separate parish, to be called "The North-West Religious Society of North Yarmouth." Moses Noyes was among the petitioners. This church, often referred to as the "Second Congregational Church in North Yarmouth was raised on the Tuttle Road near the meeting house and partook of a more conservative character. (OTNY p.23)

      Moses Noyes is listed on the 1794 Tax List of North Yarmouth as 3 pounds 6 shillings 2 pence. (OTNY p.107)

      Moses and his wife were dismissed from First Church Falmouth, Oct 1783 to church in Gorham. [King] Original church records say "The church voted to dismiss Moses Noyes and his wife and recommend them to the Communion of the Church of Xst in Gorham.

      TAG: Moses of Gorham bought in North Yarmouth in 1785 and apparently was never of Falmouth after 1776. [Cumberland Deeds 11:67, 475; 14:85; 16:361].
