    • (In the Name of God amen The Twenty Eighth Day of January A. D. 1764 I Benjamin Hale of Newbury in the County of Essex and Province of the Massachusetts Bay in New England being [sick?] and weak of body but of perfect Mind and Memory, Thanks be given to God, Therefore calling unto mind the mortality of my Body, and knowing that it is appointed for all Men once to die, Do make and ordain this my last Will & Testament, That is to say, Principally and first of all I give and recommend my soul into the Hands of God that gave it and my Body I Recommend to the Earth to be buried in decent Christian Burial at the Discretion of my Executor nothing doubting but at the general Resurrection I shall receive the same again by the mighty Power of God, and as touching such worldly Estate wherewith it hath pleased God to bless me in this Life, I Give devise and dispose of the same in the following Manner and Form.

      Imprimis I give and bequeath to Judith my dearly beloved wife two Cows to be kept for her winter and summer yearly and the Priviledge of a horse to carry her to the Publick Worship of God and all my household Goods to be Disposed of amongst my Children as she shall think proper, and three Cord of Wood yearly to be brought Home to her and one fifth Part of all the Profit and Income of all my Estate to be delivered to her yearly, also two Rooms in my Dwelling House with a Priviledge in my Cellar, yet & notwithstanding I have said and give my abovesaid one fifth Part of the Income of my whole Estate, This my Meaning is that the hay that is cut on the same she shall have no Part in, that by Reason of the two Cows are to be kept as above said, and further this my Will is that my abovesaid Wife shall have the above said Profits and Priviledges no longer than she remain my Widow.

      Item I give and bequeath to my beloved Son Ezra three acres of salt Marsh on the Easterly side of my Marsh with the Priviledge of Carting out the hay so long as he shall keep the same in his own Improvement and two Pounds in Money to be paid in two years after my Decease.

      Item I give and bequeath to my beloved Daughter Judith six Pounds in Money with what she have already had to be paid in three years after my Decease.

      Item I give and bequeath to my beloved Daughter Abigail six Pounds in Money with what she have already had to be paid in four years after my Decease.

      Item I give and bequeath to my beloved Daughter Mary six Pounds in Money with what she have already had to be paid in five years after my Decease.

      Item I give and bequeath to Sarah my beloved Daughter two Pounds in Money with what she has already had to be paid to her in six years after my Decease.

      Item I give and bequeath to my beloved Daughter Rebecca six Pounds Money to be paid in seven years after my Decease.

      Item I give and bequeath to my beloved Daughter Eunice six Pounds Money to be paid in Eight years after my Decease.

      Item I give and bequeath to my beloved Daughter Jane six Pounds Money to be paid in nine years after my Decease.

      Furthermore This my Will is that if my Wife should think fit to marry again or should decease before any or either of my aforesaid Daughters shall marry, then they and each of them until marriage Day shall enjoy the same Priviledge in my House as I have give to my wife.

      Item I give and bequeath to my well beloved Son Simeon Hale and to his Heirs and assigns forever my Estate both real & personal, excepted what I have already disposed of in this my Will, also I give him all the just Debts that are due to me, his paying all the just Debts that I owe, the Legacies that I have given in this my Will and my funeral Charge, and in Case that my said Son Simeon should decease, and Leave no lawfull Heir, Then this my Will is that my Estate that I have give to my said Son Simeon shall turn to my aforesaid Ezra his performing each and every Particular of this my Will and pay to each of my Daughters before married five Pounds each, and I do constitute make and ordain my abovesaid Simeon Hale to be my Sole Executor of this my last Will and Testament all and singular my Lands Messuages and Tenements by him freely to be possessed and enjoyed and I do hereby utterly disallow, revoke and disannul all and every other former Testaments Wills Legacies and Bequests and Executors by me in any ways before named willed and bequeathed ratifying and confirming this and no other to be my last Will and Testament In Witness whereof I have hereunto set my hand & seal the Day and year above mentioned.

    • Joined in release to father of estate of brother Samuel4, 4 Feb., 1722-3. Same date reservation of money to be paid him in deed of father to brother John4. Same date received deed of homestead from his father, he to pay sisters Margaret, Mary, Ruth, Anne, Rebecca and Sarah, etc. (39:227-229).

      March, 1725-6, received from sister Mary Hale, single woman, deed of her interest in her brother Samuel's estate. 6 Dec., 1727, received like deed from sister Ruth Hale (51:91, 92). 28 Nov., 1733, received like deed from sister Anne Hale (67:18). 16 March, 1725-6, received from brother John4 and eighteen others, 4 a. in east part of second general pasture (51:92). 9 March, 1735-6, received from Richard Kelly, of Amesbury, deed of 5 a. marsh in Newbury, bounded easterly by Moses Little, southerly by James Ilsley, etc. (78:152).
