However in the Eastern Herald of Feb. 18, 1796, a son-in-law, James Lunt, gave notice that he had "taken upon himself the trust of an administration upon the estate of Josiah Noyes, late of Falmouth, gentleman, deceased," and in the Eastern Herald and Gazette of Maine of March 9, 1797, another son-in-law, Isaac Parsons, advised that he had assumed the trust "in the room of James Lunt, Esq., now removed at his own request.")

    • (Know all men by these presents that we Cutting Noyes and Thomas Noyes, Yeomen; Amos Lunt, Yeoman and Hannah his wife all of Brunswick in the County of Cumberland; Jacob Noyes and Josiah Noyes both of Portland in the same County, Merchants; and Moses Noyes of said Portland, Yeoman; William Lowell of the same Portland, Merchant and Betsey his wife and David Hale of Boston in the County of Suffolk, Gentleman do hereby constitute and make Moses Merrill of Falmouth in said County of Cumberland Esquire our attorney for us and in our names and behalf and to our use to ask demand take recover and receive possession from any person or persons whomsoever the same may concern any lands accounts or hereditaments or any interest thereon wherever situated which formerly belonged to and was the estate of Josiah Noyes, late of Falmouth aforesaid deceased and now belongs or is coming to us as his heirs or as representatives of his heirs or any of them or in any other way whatever and all monies due or to become due for former or future sales thereof or some part or parcel thereof and further to ask demand and receive of any persons as aforesaid any monies that may be due or coming forth on account of the passes or damages committed or done to the estate aforesaid or any part thereof as well as profits thereof and all other goods, effects, credits and things whatsoever due owing, belonging and coming unto us as heirs or representatives of heirs of the said Josiah deceased and we do hereby authorize our said attorney to bargain, sell and dispose of all our interest in the estate aforesaid with all the priveledges and appurtances or any part or parcel thereof to any person or persons and for such consideration as he may see fit and thereof to sign seal and acknowledge in our behalf good sufficient deed or deed of special or general warranty as he may judge proper avoiding if possible giving warranty deeds. Giving and hereby granting our said attorney our full and whole power to commence and prosecute a final judgement and execution any suits actions real personal necessary to accomplish the purposes aforesaid and to appear in the defense of any such suits or actions moved or to be moved against us respecting the matters aforesaid a final judgement and execution and to appear before Governors, Judges, Justices and other officers and ministers of justice as occasion may require and in case of sale as aforesaid for us and in our names and behalf to sign seal and deliver in deed form good and sufficient deeds as aforesaid and for us and in our names and behalf in all cases when necessary the premesis to give and execute as occasion may require due acquittance and discharge with all further necessary incidental process the same as if particularly specified. With the power of substituting one or more attorney or attornies under him in witness whereof we do hereunto set our hands and seals this eighteenth day of March AD 1811.

    Notes 
    • Josiah Noyes of New Casco was a member of Captain James Merrill's company, Colonel Jonathan Mitchel's (Cumberland County) regiment; service, three days, in November, 1775, fortifying Falmouth; also private in Captain William Cobb's company in Colonel Jonathan Mitchel's detachment. The pay abstract for milage was sworn to at North Yarmouth, November 26, 1779. He is reported as first having drawn rations at Falmouth, and as discharged at Falmouth.

      Josiah and Mary spent their married life in Falmouth, all but the first few years on the former Zachariah Brackett place, long known as Back Cove Farm. Joseph Noyes, Esq., of Falmouth bought this property in April, 1745, for £700 Bills of last Emission [York Deeds 25:70], placed his son Josiah thereon and ten years later willed it to him, together with one hundred acres out of the testator's own home place next Capt. Isaac Ilsley's. Josiah and his brother Peter were the executors of their father's will and the residuary legatees [Maine Wills (Sargent), p.746].

      In 1802-1803 by seven deeds the home farm passed to Mr. James Deering for $8,245. There were also other Falmouth lands and an extensive Durham property.

      Currently, the entire campus of the University of Southern Maine is situated on this 400-acre parcel of land, formerly owned by Josiah Noyes on Back Cove. Farmhouse of Josiah no longer stands. Home of the estate's groundskeeper does stand, according to Nicholas Noyes, a descendant and chief librarian at the Brown Library, Maine Historical Society, Portland, Maine.

      The fathers of Anthony Brackett Jr. and Josiah Noyes were close acquaintances and both were selectman. Josiah's courage was manifest in that he bought the estate of a man who was murdered by Indians along with his entire family. Poor Anthony's luck ran out that same day when he and his family were captured by Indians.
