    • (In the name of GOD amen. I, Stephen Noyes of West Newbury, being now of sound mind and memory, but remembering the uncertainty of life and certainty of death, do ordain and publish this my last will and testament in manner and form following, viz.

      First I order all my just debts and funeral charges to be paid by my executor hereafter named.

      Item. I give and bequeath to my beloved wife Fanny A. one hundred dollars in money and the use and improvement of all my books, furniture, plate, beds and bedding during her natural life, with the right to dispose of all she brought to the house at the time of our marriage, likewise the provisions that may be in the house at my decease.

      Item. I give and bequeath to my beloved wife the income of ten shares in the Boston and Maine rail road, and if, in any year during her life, the company should not pay a dividend, I hereby order and direct my executor to pay her six per cent on the amount of one thousand dollars, for each and every year during her life that they do not pay a dividend, likewise the use and improvement of the part of the house we now occupy (the passage to the garret and cellar to be used in common by both parts of the house, the small building in rear of the house for woodhouse, the necessary in common for both familys, two seats in the pew in the meeting house where we now sit, the use of a horse and chaise for to go to meeting and on other occasions when she wishes, four cords of wood annually, two of hard and two of pine, and the one sixth part of the income of the farm we now occupy, excepting that part hereafter devised to my son Samuel C. Noyes by income is meant produce in kind or its equivalent in money the above bequests in this item are for her use and comfort during her natural life.

      Item. The money that may be the house at the time of my decease to be divided between my wife and my sons Stephen E. Noyes and Samuel C. Noyes equally share and share alike.

      Item. I give and bequeath to my son Stephen E. Noyes in trust to be expended for the support of my son Thomas Noyes now at the Hospital at Worcester the money I may have deposited in the Savings Institution Newburyport at the time of my decease and in case the said Thomas should decease before the money should be needed for his support the same shall remain in the hands of my son Stephen E. Noyes for his own use and benefit.

      Item. I give and bequeath to my son Samuel C. Noyes the lot of land situated in West Newbury formerly owned by my brother Samuel Noyes containing about nineteen acres and is bounded by Batchelder street southward, my own land, land of the late Wm. Pilsbury and land of John Moody. I likewise give to him the stock I own in the Haverhill banks, the money I may have deposited in the Savings bank Haverhill at the time of my decease and two shares in the Rocks bridge, likewise the one half of my wearing apparel to him and his heirs forever.

      Item. I give and bequeath to my son Stephen E. Noyes all the rest residue of my estate, both real, personal & mixed, wherever the same may be situated, he to furnish my wife if she if she should outlive me, with the use of the horse and chaise if she she wishes to go to meeting or to ride on other occasions likewise to pay to my wife during her natural life the one sixth of the income of the farm on which I now reside (excepting that part I have devised to my son Samuel) and in addition to furnish her with four cords of wood, to him and his heirs forever.

      In testimony whereof, I have hereunto set my hand and seal and publish and declare this to be my last will and testament in the presence of the witnesses named below this eighth day of May in the year of our Lord one thousand eight hundred and fifty.
