    • (Know all Men by these Presents, that We Thomas Noyes of Brunswick in the County of Cumberland yeoman, Amos Lunt of said Brunswick yeoman Hannah his wife in her own right, Josiah Noyes of Portland in said Countymerchant, Moses Noyes of said Portland yeoman, William Lowell of said Portland housewright and Betsey his wife in her right, David Howe of Boston in the County of Suffolk gentleman, Moses Merrill of Falmouth in said County and Jane his wife in her own right and likewise in his own right.

      In consideration of the sum of two hundred and seventy five dollars paid us by Silas Estes of Durham in the County of Cumberland yeoman the receipt whereof we do hereby acknowledge, do hereby give, grant, bargain, sell and convey unto him the said Silas Estes and his heirs and assigns forever, a certain piece of land in Durham in said County being a part of the Noyes eight hundred acres at the Southwesterly corner of the land which the said Estes bought of John Ward thence Northwesterly fifty rods adjoining said road to a stake, thence Northeasterly one hundred and sixty rods to a stake, thence Southwesterly fifty rods to the said Estes land which he purchased of said Ward, thence Southwesterly adjoining said Estes land to the road the first mentioned bounds containing about fifty acres.

      To Have And To Hold the same with all the privileges and appurtences thereof to the said Silas Estes and his heirs and assigns to his and their sole use and behoof forever ... and we do hereby for ourselves our Prosecutors and Administrators covenant and engage to and with the said Silas Estes heirs and assigns that mean lawfully seized in fee of the premises; that they are free of all incumbrances; that we have good right to sell and convey the same in manner aforesaid. And that we and our heirs will warrant and defend the same to him the said Silas Estes his heirs and assigns forever, against the lawful demands of all persons.

      In witness as herefore have hereunto to set our hands and seals this tenth day of December in the year of our Lord one thousand eight hundred and eighteen

      "Moses Merrill (1744-1834) enlisted, 1775, as a private in Capt. Samuel Noyes' company, Col. Edmund Phinnie's 31st regiment. He was born and died in Falmouth, Maine."

      The Merrills deeded one-eighth of the homestead [Cumberland Deeds 38:67], and in 1818 Moses Merrill, Esq., as attorney for the heirs sold part of the "Noyes 800 acres so called" in Durham [ibid. 81:200; 96:535].
