- (In the name of God amen. this eighteenth Day of November anno Domini 1751 and twenty fifth Year of the Reign of our Sovereign Lord George ye 2d. [__] I Thomas Noyes of Newbury in ye County of Essex in His Majesties Province of the Massachusetts Bay In New England Gentleman being in good health of body and of a sound mind & memory (thanks be to God for it) calling to mind my own mortallity, Do make and Ordain this my last Will and Testament – Principally & first of all I Humbly Commend my soul into the hand of God who Gave it and my body to the Earth to be buried In decent Christian burial at the Discretion of my Executors, Nothing Doubting that at ye General Resurrection I shall Receive the same again by the mighty power of God, and as touching such Worldly Goods Wherewith it have pleased God to To bless me with in this life I give D[evis?]e and Dispose of in the following manner and Form.
Impr. I give and bequeath unto my dear & Well beloved wife Elizabeth Noyes all the household stuff and Utensils shee brought with her When shee Came to my house on marriage, to be at her dispose forever, and [Otherwise?] I give unto my said Wife Elizabeth the use & Improvement of the Lower Room in my house that I now Dwell in next the Country road, with [Conveniency?] of Cellar room and an oven in the other room as shee shall have Occasion to use & improve the same, with a liberty of drawing water at the well, with one third part of my Real & personal estate, And wood sufficient to keep one fire, to be by her Improved for her subsistence, so long as shee Continues my widow, But if my sd. Wife Eliza. shall Chuse to remove from my house I Do give her the sum of nineteen pounds fifteen shillings In money, and what shee brought with her to my house as abovesaid, with what linnen cloth that was made up that have been by her spun since shee came to my house, upon my sd. wifes requesting All her right title & Interest in my estate unto my two sons Thomas Noyes & Stephen Noyes whome I Do hereby Order to pay the money and Deliver the goods & cloth before specified.
Item. I give and bequeath unto my two sons Thomas Noyes & Stephen Noyes all my Estate (not before Disposed of) of what name or nature soever that I am now possessed of Or that shall come hereafter by Virtue of me, to be by them as an Absolute Estate in fee simple in Equal halves [_]oth Land wood & lumber Excepting my new house & silver hilted sword, I give to my eldest son Thomas, and my Old house my brass hilted sword & cane to my youngest son Stephen Noyes, And all Other my Estate to be divided Equally between them both for quantity and quallity And I Do herbeby constitute and appoint my sd. two sons Thomas Noyes & Stephen Noyes The Executors of this my last Will and testament To pay all my Just Debts legacies & Bequests to their mother in law Eliza. my wife [_] Funeral Charges in equal proportion between them.
Lastly. I do hereby Renounce all former Wills by me made Rattifying & Confirming this & no other to be my last Will & testamt. In Witness Whereof I have hereunto sett my hand & seal ye day & year above Written. Signed Sealed pronounced & Declared by ye said Thomas Noyes to be his last Will & testamt. in presence of

- He was a Captain in the Colonial service.
Family tradition says Thomas Noyes was a bachelor into his forties.
In fact, the street he lived on was called Bachelor Street because this was the street that lead to the 'bachelor's' home.
Stephen Emery told him that he should be married and told Thomas that he could have his choice of his daughters.
Thomas chose to marry Mary.
